Roblox’s Steal A Brainrot Creators Sue Fortnite Copycat Over Alleged Infringement

The creators of Steal A Brainrot, one of Roblox’s most popular games, have filed a lawsuit against the developer of a Fortnite Creative map they claim is a blatant copy.

The case, filed in California, pits Spyder Games and Speedy Simulator Gaming against developer Thomas Van Der Voort, who released a Fortnite map titled Stealing Brainrots just two months after the Roblox hit went live.


According to the complaint, the Fortnite version allegedly lifts “protectable expressions” from the Roblox original. That includes everything from user interface elements and in-game objects to artwork, level design, and even the overall aesthetic.


The plaintiffs argue these similarities aren’t just the result of both games existing in the same genre, but rather “conscious decisions” to replicate their creative work.

The Roblox title has been a massive success since its launch in May 2025. It has racked up over 5.95 billion plays and peaked at more than 20 million concurrent users, consistently ranking among the top-3 games on the platform.


Meanwhile, Fortnite’s Island Creator Program — where Van Der Voort’s free to play game was uploaded allows creators to earn money through "engagement payouts." That financial incentive, the lawsuit claims, gave the defendant reason to copy Steal A Brainrot in hopes of capturing its audience.


The plaintiffs are requesting a jury trial and seeking damages, profits from the alleged infringement, and a permanent injunction to remove Stealing Brainrots from Fortnite. They’re also asking for punitive damages, attorney fees, and interest.
